Terms and Conditions

1. Introduction

These Terms and Conditions ("Terms") govern all purchases made through our online store ("Store"). By placing an order, you accept and agree to these Terms in their entirety.

2. Contract Language

The languages available for the conclusion of the contract are German and English.

3. Contract Formation

The purchase contract is finalized when the customer clicks the "Order" button in the shopping cart, confirming their intent to purchase and their agreement to these Terms.

4. Custom Production Policy

All products are custom-made upon purchase and are not pre-manufactured.

Once an order is placed and production begins, it cannot be canceled or modified. This transaction is exempt from the scope of application of the Distance and Off-Premises Contracts Act (FAGG) and the Consumer Protection Act (KSchG).

5. Payment Terms

Payment Method: Currently, only PayPal is accepted as the payment method.

The seller reserves the right to change the accepted payment methods by updating these Terms.

Payment in full, including the product price, shipping fees, and any applicable taxes, is required at the time of purchase.

Ownership of the product transfers to the purchaser only upon receipt of the full payment.

6. Shipping and Delivery

Customer Liability for Shipping: The purchaser assumes full responsibility for the shipment, including liability for damages, delays, or losses during transit.

Delivery Times: All delivery times are estimates only and are not legally binding.

No Self-Pickup: Self-pickup of the products is not possible. All orders must be shipped.

7. Subcontractors

The seller works with various subcontractors for the production and delivery of the products.

These subcontractors handle the entire manufacturing process as well as the delivery to the customer.

The seller does not operate physical stores or maintain inventory.

Data Sharing with Subcontractors:

The customer explicitly and irrevocably agrees to the transfer of necessary personal data for order processing to the relevant subcontractors.

Data Transfer to the USA: The customer acknowledges that personal data may be transferred to and processed in the United States. Since the USA is not recognized as providing an adequate level of data protection under European Union law, the customer explicitly consents to the transfer and processing of their data in the USA.

The seller will ensure that the necessary safeguards for the protection of the customer’s personal data are in place, such as contractual agreements with the subcontractors, in accordance with the General Data Protection Regulation (GDPR).

8. Exclusion of Warranty

Warranty: Warranty claims are excluded for all products sold.

9. Claims and Liability

Claims for any issues, including damage or defects, must be made within 7 calendar days of delivery.

Claims can be made by contacting the seller directly through the provided communication channels. The customer must provide all relevant information, including order number, description of the issue, and supporting images if applicable.

Any and all claims related to the purchase, including product issues or disputes, must be submitted to the right court within 6 months of delivery. After this period, the seller bears no further liability. The customer expressly acknowledges that the presumption under law, that defects already existed at the time of delivery, does not apply. If this exclusion is not possible by law, the limitation period for claims is 7 days from the date of delivery.

10. No Returns or Refunds

Due to the made-to-order nature of the products, all sales are final.

Returns, exchanges, or refunds are not permitted.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of Austria. The UN-Sales Law is excluded.

Any disputes shall be resolved exclusively in the court of Klagenfurt, Austria.

12. Limitation of Liability

The seller is not liable for damages, delays, or losses or any indirect, incidental, or consequential damages related to the use of the product.

13. No Reliance

Customers agree not to rely on any representations or promises beyond those explicitly stated in these Terms.

14. Storage of Contract Text

The contract text is not stored by the seller after the conclusion of the contract.

15. Acceptance of Terms

By completing a purchase, including clicking the "Order" button, the customer confirms they have read, understood, and agreed to these Terms in full. The seller reserves the right to change the accepted Terms by updating these Terms.
